Terms and Conditions

These Terms and Conditions govern your use of the EmblemCaps website (emblemcaps.com) and your purchase of products from us. EmblemCaps is a brand owned by Digitizing LLC. By placing an order or requesting a quote, you agree to these Terms.

1. Definitions

  • "We", "our" and "us" refer to EmblemCaps, a brand owned by Digitizing LLC.
  • "You" and "your" refer to the customer placing an order or requesting a quote with us.
  • "Products" means the custom caps, beanies, bucket hats, flat caps, headbands and any other headwear we supply, together with the bespoke embroidered badges applied to them.

2. Custom, Made-to-Order Products

  • All Products supplied by EmblemCaps are custom-made to order and personalised to your specification.
  • We do not sell ready-made or stock headwear.
  • By placing an order or quote request, you acknowledge that you are purchasing a bespoke, personalised product created specifically for you.

3. Orders, Quotes and Approvals

  • Custom headwear is priced according to your chosen hat style, badge design and quantity. After you submit a request, you will receive a quote for review.
  • Our minimum order quantity is 26 units per order.
  • A one-off setup fee of £10 applies to cover the digitising of your embroidered badge.
  • Before manufacture, our process includes two approval stages designed to protect you:
  • Digital mockup approval — you review and approve a digital visual of your badge on your chosen hat.
  • Physical sample approval — we produce a real production sample and send you a photograph of it for sign-off.
  • Production only begins once you have approved both stages and payment has been received.
  • Standard turnaround is approximately 10 to 21 working days from your final approval, though this may vary by product type and quantity.

4. Your Customer Dashboard

  • A complete record of your orders and quotes, including approvals, corrections and shipping updates, is available in your customer login dashboard on our website.
  • Emails act as notifications only. Your dashboard is the primary record of your transaction.

5. Intellectual Property and Design Use

  • You confirm that you hold all necessary rights or permissions to use, reproduce and submit any artwork, logos or designs you provide to us.
  • All intellectual property rights in your original design remain with you.
  • To fulfil your order, we may create production artwork or digitised embroidery files (such as DST, EMB or similar machine formats) required for manufacturing.
  • These production files remain the property of EmblemCaps and are not supplied to customers. You receive the finished physical Products you ordered, not the underlying production files.
  • By submitting a design, you grant us a non-exclusive, royalty-free licence to create and use such production artwork solely for manufacturing and delivering your order.
  • Unless you notify us in writing at the time of order, we may showcase completed designs in our portfolio, marketing or social media.

6. Revisions and Corrections

  • Please check your digital mockup and physical sample carefully before approving, as these are your opportunities to request changes.
  • If a genuine defect or discrepancy from the approved specification is identified, you may report it to us within 14 days of delivery.
  • Corrections requested outside this timeframe, or arising from information you supplied incorrectly, may incur additional charges.

7. Your Statutory Rights, Refunds and Returns

  • Because all Products are custom-made and personalised to your specification, they are exempt from the standard 14-day cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Once you have approved your mockup and sample and production has begun, orders cannot be cancelled or returned for change of mind.
  • Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. If Products are faulty, not as described, or not of satisfactory quality, you are entitled to a remedy such as repair, replacement or refund.
  • Refunds or replacements are not available for customer errors (for example, incorrect quantities, colours or details that you submitted and approved) or for change of mind after approval.

8. Payments

  • Prices are shown in pounds sterling (GBP, £) and payment must be made in accordance with the terms shown at checkout.
  • Payments are processed securely by trusted third-party providers such as Stripe. We do not store or access your full card details.
  • Overdue accounts may be subject to interest and reasonable administrative charges as permitted by applicable law.

9. Liability

  • We will use reasonable efforts to correct valid issues reported within the stated timeframe.
  • Except in respect of your non-excludable statutory rights, death or personal injury caused by our negligence, or fraud, our total liability is limited to the amount you paid for the Product or service in question.
  • We are not liable for indirect or consequential losses, or for delays or errors arising from incorrect information or artwork supplied by you.

10. Data Privacy

  • By placing an order or requesting a quote, you agree to our Privacy Policy.
  • Your data may be shared with trusted third parties (for example, production and digitising partners, couriers, and payment processors such as Stripe) strictly for order fulfilment or legal compliance.
  • We never sell, rent or trade customer data.

11. Design Storage

  • We may store your designs for a limited period as a convenience.
  • We do not guarantee long-term storage and recommend that you keep your own backup of your original artwork.
  • We accept no liability for files that become unavailable after our retention period.

12. Marketing Communications

  • Existing customers may receive occasional service updates, order notifications or relevant offers under legitimate business interest, with a clear opt-out.
  • Non-customers will only receive marketing communications with explicit consent.
  • You may opt out at any time via the unsubscribe link or by contacting us.

13. Governing Law and Jurisdiction

  • These Terms are governed by the laws of England and Wales, and any disputes will be subject to the jurisdiction of the courts of England and Wales.
